User Obligations

By purchasing our hardware or using our services, you consent and agree to the following: (i) you will notify Instant Tracking of any defect in the Services within five (7) days of a malfunction; (ii) you will test the Services regularly in accordance with instructions provided to the you by Us. If your Product is lost or stolen, you must contact us immediately to report the loss or theft. We will not provide you with a replacement Product if your Product is lost or stolen.

Service

Instant Tracking will provide an online tracking service to you for use with hardware supplied by Instant Tracking. This service is supplied "as is" with no express or implied warranty for accuracy or accessibility. We will assign the Customer a logon name and password which will provide you with access to the tracking server From time to time we must perform scheduled maintenance to servers, we will use reasonable efforts to keep outage times to a minimum. and Where we need to perform unscheduled maintenance, We will use reasonable efforts to restore any service outages as soon as reasonably possible.

Coverage

Our tracking service utilises the free to air GPS satellites and Telstra's Next G data network, Our service depends on the tracking unit being within Telsta Next-G coverage area, and the ability to maintain a valid GPS fix which requires the GPS antenna to have a clear unobstructed view of the sky. Coverage for the Next-G service is not available in all areas. Telstra prepares coverage maps, please visit http://www.telstra.com/mobilecoverage to check for coverage areas. With any network based on radio technology, signal quality or local conditions may prevent or interfere with signal reception and transmission. Other factors that may also degrade the service include (and are not limited to) Carparks, Underground Carparks, Garages, Tunnels, High rise buildings.

Cancelling or Suspending Services

You may cancel the Service at any time by notifying us in writing. If you cancel a service before we have provided it to you, we may charge you any costs incurred by us in preparing to provide it to you. We may suspend or cancel a Service in a number of circumstances, including, if you fail to pay your bill on time or we otherwise reasonably believe you are a credit risk, there is excessive use or misuse of the Service, we reasonably suspect fraud or other illegal conduct in connection with the Service, the law allows or requires us to, or you become bankrupt or insolvent. If a Service is cancelled or suspended you will be required to pay all charges incurred before cancellation or suspension.

Billing and Payment

Accounts will roll on a monthly basis in advance, without notice to you. You must advise us prior to the auto-renewal date if you wish to cancel the Service. If we do not receive your cancellation or 'do not renew' advice, we will auto-renew the Service in order to ensure it continues uninterrupted. Invoices are sent electronically to the email address provided by you on your Account. Services can only be paid from your credit card or by direct bank deposit. Unless otherwise agreed by the parties in writing, payment shall be made within 14 days from the the date of the invoice. If you do not pay a bill by its due date, we can charge you interest on the overdue amount, or a fee or both. Further, if the account is not paid by the due date we may suspend, restrict or cancel the Service until you pay. You must ensure that your contact details are current at all times.

Availability

Unless otherwise stated, the services featured on this website are only available within Australia. All advertising is intended solely for the Australian market. The Company does not warrant that the service from this site will be uninterrupted, timely or error free, although it is provided to the best ability. By using this service you thereby indemnify this Company, its employees, agents and affiliates against any loss or damage, in whatever manner, howsoever caused.

Warranty on Hardware

Instant Tracking GPS Trackers come with a 12 month warranty from the date of purchase . Instant Tracking warrants its products against defects in materials and/or workmanship for a period of twelve (12) months. If a defect arises and a valid claim is received by Instant Tracking, We may at our option, repair or replace the product. Instant Tracking will not be liable for damage to the product or property due to misuse or improper installation, improper care or maintenance of the products. Instant Tracking will not be liable for any loss, damage or alterations to third party hardware, software, programs, data and/or information stored on any media or any part of the Product, no matter how occurring; or for any loss or damage arising from loss of use, loss of profits or revenue, or for any resulting indirect or consequential loss or damage.

Notification of Changes

Instant Tracking reserves the right to change these conditions from time to time as it sees fit and your continued use of the site will signify your acceptance of any adjustment to these terms. These terms and conditions form part of the Agreement between the Client and ourselves. Your accessing of this website indicates your understanding, agreement to and acceptance, of the Disclaimer Notice and the full Terms and Conditions contained herein.
